What is the Fan XP?
The Fan XP Innovation Challenge (also referred to as the “Fan XP”) consists of an online call to start-ups with specific solutions to fan engagement. Ten applicants will be selected by an experts committee and invited to participate in a pitch competition and receive mentoring sessions in Barcelona (Spain). The Fan XP is comprised of three different phases:
1. Application: phase where those who want to become eligible enter the Website and register to the Fan XP according to these Terms and Conditions and the provided deadline. All Applicants will receive an email informing them of their participation being accepted or rejected.
2. Participation: those Applicants that have been accepted will participate in the second phase where the Fan XP Jury will analyse the different projects and proposals and select ten (10) Finalists that will have the right to participate in the final phase of the Fan XP.
3. Final Phase: Finalists, provided that they comply with these Terms and Conditions, will have the right to go to Barcelona to participate in the final phase of the Fan XP, a 3-day program during which Finalists will be involved in the following activities:
- One-to-one mentoring sessions with Euroleague Basketball executives to discuss the potential applications of the projects and receive advice and feedback
- Participate in conferences offered by 4 Years From Now
- Exhibition at the 4 Years From Now area within the Barcelona Mobile World Congress
- Innovation Conference hosted by Euroleague Basketball at 4YFN
- Pitch competition between the selected finalists
- Networking opportunities
Fan XP organization
The Fan XP is conducted and run by Euroleague Properties SA (hereinafter referred to as the “Organizer”).
All entries must be made in accordance with the following Terms and Conditions.
The Organizer reserve the right to cancel or amend the Fan XP and these Terms and Conditions without notice in the event of any unexpected reason outside the control of the Organizer (including but not limited to an act of God -such as earthquakes and other national disasters), war, terrorism (or credible threat thereof), damage to public transport, power outages, weather or labour disputes, medical disaster, civil or military disturbance, civil commotion or any actual or anticipated breach of any applicable law or regulation or any other event outside the Organizer’ control or which make it desirable to do so. Any changes to the Fan XP will be notified to participants as soon as possible by the Organizer. All participants agree that no liability shall attach to the Organizer as a result thereof and that the exercise of such discretion shall not result in any compensation being payable or paid to any participant or other person.
Any and all rights in relation to the Fan XP are the sole and exclusive property of the Organizer. No data, materials, documentation or any kind of information may be reproduced in any format or used in any way without the prior written consent of the Organizer, who shall be entitled to withhold consent at its sole discretion.
Who Can Participate in the Fan XP?
All registration applications to participate in the Fan XP must be made by start-ups or individuals or group of people that are in early stages (pre-sales) or in its first years of business (up to 3 years after sales have started) that present an innovative business model within the sports sector or in sectors that, being different from the sports sector itself, can be directly or indirectly applied to sports with a clear and effective impact on fan engagement (the “Applicants”) on the official electronic application form available on the Fan XP website (https://fanxp.euroleague.tech/). Applicants under 18 years of age are not permitted to participate in the Fan XP. Applications must adhere to the required format.
Only those Applicants that comply with these Terms and Conditions will be eligible to be accepted for participation in the Fan XP. Acceptance of the application and participation to the Fan XP is at the free discretion of the Organizer. All Applicants will be notified by the Organizer via electronic messages informing whether their application has been accepted or not. Organizer reserve the right to exclude entrants when they do not meet the requirements set forth in these Terms and Conditions for the full duration of the Fan XP.
The computer record of the registration application will be considered as being the formal application. Any application not adhering to the above format, incorrect applications or incomplete applications will be deemed invalid.
Applicants must bear in mind that full availability for participation in case they qualify for the final stage of the Fan XP will be needed. Final phase will be held in Barcelona (Spain) from February 24 to February 26, 2020.
How to apply
Visit http://fanxp.euroleague.net/ (the “Website”) and complete the application form in accordance with the requirements set forth in these Terms and Conditions before January 17th 2020 at 23:59 CET (“Submission Deadline”).
Any application submitted after the date and time specified above will not be accepted, unless otherwise confirmed by Organizer.
Only English-language applications will be accepted.
Applicants who comply with the requirements set forth herein and these Terms and Conditions may be accepted to participate in the Fan XP. Acceptance to participate in the Fan XP does not guarantee participation in the Final Stage of the Fan XP, which shall be in all cases subject to subsequent selection by the Fan XP Jury.
By submitting the application form, participants agree to be bound by these Terms and Conditions.
By submitting a registration application, participants hereby warrant that all information submitted is true, current and complete.
Participants are solely responsible for their profiles, personal information(s) and company’s information (the “Submissions”) they submit and that they may, upon acceptance, become visible on the Fan XP Website, Euroleague Basketball websites and social media accounts and Euroleague Basketball Media Partners listed here.
Participants represent and warrant that: (i) they are free to enter into and are fully authorized to enter into the Fan XP; (ii) the Submissions they have entered are true; (iii) the posting of the Submissions on the Fan XP Website or any other Euroleague Basketball website, or the use by the Organizer of the Submissions as permitted under these Terms and Conditions shall not violate the privacy rights, intellectual rights, copyrights, contract rights or any other rights of any third person or company.
Participants shall not have any actual or potential conflict of interest with the Fan XP, the Organizer or the Fan XP Jury and must inform immediately if they become aware of any such conflict of interest.
Participants understand and agree that participation acceptance in the Fan XP does not grant them any IP rights. In this sense, participants shall not use the Organizer logos (including the Fan XP logo) or publicly announce any link or involvement as participants in the Fan XP or any other form of consideration until they have been selected as Finalists and have been confirmed to participate in the final phase by signing the corresponding documentation.
All participants must comply with all these Terms and Conditions and must qualify in accordance with such Terms and Conditions at each stage of the Fan XP.
All participants understand that all materials, documents, presentations and other information delivered or made available in relation to the Fan XP, either oral or written (the “Materials”) is the property of the Organizer. No information or data in relation to the Materials may be shared with third parties, reproduced in any format or used in any way without the prior written consent of the Organizer, who shall be entitled to withhold consent at their sole discretion.
These Terms and Conditions have been drafted in English. Participants acknowledge and agree that they have read and understood these Terms and Conditions and that are fully aware of the rights and obligations arising therefrom.
By participating in the Fan XP, participants agree that no claim relating to losses or injuries or disappointment suffered by entering the Fan XP (including special, indirect and consequential losses) shall be asserted against the Organizer, its parent companies, collaborators, sponsors, affiliates, directors, officers, employees or agents from any and all losses, damages, rights, claims and actions of any kind resulting from the participation in the Fan XP or the attendance at the final phase of the Fan XP.
Participants understand and agree that Organisers will have no responsibility for any participant’s costs and expenses related to their participation in the Fan XP and participation is at their sole risk.
Once the Submission Deadline is closed, all applications submitted will be analysed in order to ensure compliance with the eligibility requirements. Only those who comply with the requirements at Organizer’s discretion may be eligible to participate in the Fan XP. Organizer will send a communication email informing all Applicants on whether their application and participation in the Fan XP has been confirmed or not.
Those projects from Applicants that have successfully passed the first stage and have been confirmed their participation in the Fan XP will be analysed and evaluated by the Fan XP Jury, a committee integrated by Euroleague Basketball staff together with selected experts, will analyse all applications submitted and confirmed. This Fan XP Jury may, at its discretion:
- Request for more documentation related to the business model or other information deemed necessary to verify compliance with the requirements to participate.
- Request to hold a personal interview or skype call.
- Others that may be deemed necessary for the Fan XP Jury in order to properly evaluate the application.
The Fan XP Jury will shortlist ten participants taking into account the following criteria: interest and possible value contribution to the sports industry; growth potential and potential implementation/roll out difficulties. Those selected by the Fan XP Jury in accordance to the above will be the ones entitled to participate in the final stage of the Fan XP (the “Finalists”).
Finalists will be contacted by email to the email address provided in the application form no later than January 30th 2020. Selected Finalists need to confirm attendance by February 3rd 2020. If a Finalist cannot be contacted and/or no timely acceptance has been received by Organizer, Finalist will lose its right to participate and the spot will be awarded to another Participant on February 4th according to the above-referred criteria. If this Participant does not provide confirmation within seven days from notification, the spot may be reassigned or cancelled, at Organizer’ discretion.
Finalists will be invited to participate in the final stage of the Fan XP which will be held in Barcelona from 24 to 26 of February 2020 with up to a maximum of two (2) representatives. Finalists will be provided with accommodation (a total of 4 nights - accommodation only) in Barcelona during the final phase of the Fan XP. Transportation and any other costs (including but not limited to flights, meals and local transportation, insurances or medical costs) is to be covered by the Finalists.
Finalists are responsible for holding a valid passport and obtaining a valid visa, if necessary.
Finalists will be required, as a condition of participating in the final phase of the Fan XP, to sign a separate agreement regulating their participation in the final phase of the Fan XP including terms of participation, non-disclosure agreement, intellectual property rights and use of Fan XP related logos, liability release and/or publicity release and/or a consent and release for photographs and video tape (for informative and commercial purposes, including but not limited for internet and social media use), or any applicable forms requested by authorities or the Organizer. Failure to do so may result in disqualification.
Organizer will have final saying in all matters related to the selection process of the Fan XP.
Pitch Competition and awards
During the last day of the Fan XP each Finalist will present a pitch of their project to the Fan XP Jury. Awards will be made by the Fan XP Jury to the highest performing Finalists. Fan XP Jury shall have full discretion in assigning the awards, including the right of making them vacant.
Under no circumstances may the application in the Fan XP or the participation in the Fan XP (including in its final phase), imply and rights being granted to the participant unless otherwise expressly stated. An award does not entail any kind of right to awarded Finalists (including but not limited right to enter into any commercial agreement with the Organizer). Notwithstanding the foregoing, Organizer may discretionary decide to grant one or more of the awarded Finalists to test their project in the environment of the Organizer’ events or official competitions.
Fan XP Disclaimer
Organizer is not responsible for applications or information lost or delayed in the course of transmission. Likewise, electronic registration application acceptance messages that are either "undeliverable" or that remain undelivered will nullify the application and will result in the participation in the Fan XP not being accepted. Organizer shall not be liable for electronic acceptance messages which are either not received or wrongfully sent or are "undeliverable" or remain for any reason undelivered.
Organizer cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any participant of the Fan XP. Organizer is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to Participant or Finalists or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials related to the Fan XP.
Organizer’s decision in respect of all matters to do with the Fan XP will be final and no correspondence will be entered into.
Organizer may refuse or withdraw, any application that in the judgement of the Organizer violates these Terms and Conditions or which may be offensive, inappropriate, illegal or violates the rights of any person or in any way brings the Fan XP, the Organizer and/or their brand names into disrepute.
The Organizer is not responsible for any malfunction of the Website or any late, lost, damaged, misdirected, incomplete, illegible, undeliverable, or destroyed information due to system errors, failed, incomplete or garbled computer or other telecommunication transmission malfunctions, hardware or software failures of any kind, lost or unavailable network connections, typographical or system/human errors and failures, technical malfunction(s) of any telephone network or lines, cable connections, satellite transmissions, servers or providers, or computer equipment, traffic congestion on the Internet or at the applications website site which may limit the Participant’s ability to participate.
All information provided in connection with the Fan XP is provided "as- is" without warranty of any kind. Organizer make no representations and disclaims all express, implied, and statutory warranties of any kind to the participants and/or any third party including, without limitation, warranties as to accuracy, timelines, completeness, or fitness for any particular purpose.
Organizer reserves the right to modify these Terms and Conditions at any time without prior notification to participants. A notice will be posted on the Website.
Personal data provided when registering to participate in the Fan XP (the “Data”) will be included in the following databases:
The Data will be processed in accordance with all applicable national and international data protection laws including those derived from European General Data Protection Regulation 2016/679.
The purpose of the Data collection is to manage your application and, if applicable, participation in the Fan XP (to ensure that you meet the criteria to be a participant, to evaluate projects and select Finalists and to communicate with participants), as well as, with respect to the Finalists, and upon express consent to it, to use their image in order to publicly disseminate their condition of Finalists. The purpose of the Data collection is also to improve the Fan XP and to contact Participants and Finalists with information about the Fan XP.
The legal basis for the processing of Data is as follows:
· With respect to the management of participation in the Fan XP, the execution of the Fan XP under the Terms and Conditions set forth herein, the processing of personal Data linked to that purpose is strictly necessary to comply with this legal relationship;
· Regarding the use of the image of the Finalists, the Finalists’ own consent.
· Compliance with the obligations imposed on Euroleague Properties, S.A. by the applicable regulations. The processing of personal Data linked to this purpose is strictly necessary in order to comply with the aforementioned legal obligations.
Participants can exercise, at any time, under the terms established by law, their rights of access, rectification or deletion of data, as well as request restrictions on the processing of their personal data, oppose its processing or request the portability of their data, by writing an e-mail to the following address: [email protected]
In any case, a complaint may be filed before the competent data protection authority.
Applicants, Participants and Finalists Intellectual property
Intellectual property rights (including but not limited to logos, trademarks, copyright, designs), and materials, documentation and information used by the participants within the scope of the Fan XP or created by Finalists during the course of the Fan XP (the “Content”) shall be owned by the corresponding participant / Finalist.
Organizer will use the Content submitted by participants only for the purposes of analysing the Content submitted and the compliance with all requirements and evaluating their projects. For this purpose, Content will be shared with the Fan XP Jury for the sole purpose of evaluating the proposals. No use of the Content provided by participants will be made beyond the specified herein.
Participants expressly consent to making publicly available the submitted Content and projects presented to the Fan XP. Notwithstanding this, Organizer shall only publish general information about the participants (Company name, brief description, country, website) as well as the title of the presented project and a short description provided by them in the application form.
In addition to the above, Content submitted by Finalists may be used by Organizer and their respective affiliates (including but not limited to Euroleague Ventures SA). In this sense, Finalists grant the Organizer and their respective affiliates (including Euroleague Ventures SA) a non-exclusive, perpetual, royalty-free, worldwide, transferable license to use, modify, copy, translate, adapt, publicly display, publicly perform, transmit, reproduce, store and distribute the Content for internal and external uses, including but not limited for marketing, promotional and similar purposes (including online content, internet and social media), always in relation to the Fan XP.
Organizer agrees not to share the Content with third parties not related to the Fan XP without the consent of the participant.
Breach of the Terms and Conditions or any rules of the Fan XP
In the event any participant is found to be in violation of any rules of the Fan XP or is found to be involved in any form of fraud, misrepresentation, dishonesty, unethical behaviour, breach or alleged infringement, the Organizer reserves the right to initiate legal proceedings against such participant and take any other action in its sole discretion including but not limited to recovering any expenses it may have paid or incurred in relation to that fraud, misrepresentation, dishonesty, unethical behaviour, breach or alleged infringement.
Participants shall hold harmless, defend and indemnify the Organizer, and their respective affiliates, employees, officers, contractors, partners or other persons used by them in relation to this Fan XP against any loss, claim, demands, costs, damages, judgments, expenses or liability (including legal costs) arising out of or in connection with any or all claims or alleged claims, that may be brought against the Organizer, or by any third party in connection with the participant’s involvement in the Fan XP and shall reimburse the Organizer for any loss, costs, expense, or damage to which said indemnity applies.
These Terms and Conditions shall be governed and construed in accordance with the laws of Luxembourg, without regard to principles of conflict of laws, and the parties submit to the exclusive jurisdiction of the Luxembourgish courts. If any provision of these Terms and Conditions is held by a court of competent jurisdiction to be invalid or enforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect. Organizer’ failure to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision unless acknowledged and agreed to by the Organizer.
